Welcome to LisbonBoat (https://lisbonboat.pt/). These Terms and Conditions govern your use of our website and the booking and provision of our maritime tourism services, including boat rentals with a skipper (charters), private cruises, group tours, water sports, and fishing experiences.

By accessing this website, making a reservation, or boarding our vessels, you agree to comply with and be bound by the following terms.

1. General Information & Company Identity

Lisbon Boat is a commercial brand operated by GOLDPRESTIGE PORTUGAL UNIP. LDA, a registered company in Portugal with NIF/NIPC (Tax/Corporate Number) 513512861, with its registered office located at Rua Dom Nuno Álvares Botelho, 65, R/C Esqº 2870-827 Montijo.

Licensing: Fully authorized maritime tourism operator registered with Turismo de Portugal under RNAAT License No. 285/2015.

Operating Locations: Marina de Cascais, 2750-800 Cascais, Portugal / Marina Parque das Nações, 1990-193 Lisboa, Portugal.

2. Services, Bookings, and Prices

Booking Methods: Reservations can be made online via our website contact forms, WhatsApp/Viber/Telegram channels, or by direct phone communication.

Availability & Confirmation: All bookings are subject to vessel availability and final written confirmation from Lisbon Boat.

Prices and Taxes: All prices listed on our website are in Euros (€) and include VAT (IVA) at the legal rate in force in Portugal, unless explicitly stated otherwise.

Accuracy of Information: Clients are responsible for providing the exact number of participants, ages (especially for minors), and any special requirements at the time of booking. The passenger capacity of each vessel is strictly limited by Portuguese maritime safety laws.

3. Right of Withdrawal (Legal Exemption)

In accordance with Article 17, Paragraph 1, Subparagraph k) of Portuguese Decree-Law no. 24/2014, of February 14, the standard 14-day right of withdrawal does not apply to contracts for leisure services or activities that provide for a specific date or period of performance. Consequently, once a booking date is locked in and confirmed, cancellations are governed strictly by our Cancellation Policy (Section 4).

4. Cancellations, Rescheduling, and Weather Conditions

Weather and Force Majeure: Maritime-tourism activities depend entirely on safe meteorological and hydrographic conditions. For safety reasons, the Captain/Skipper or the Portuguese Maritime Authorities (Capitania) have ultimate command and reserve the right to alter itineraries, change routes, or cancel trips due to adverse weather, rough seas, technical breakdowns, or official port closures.

While we always aim for a perfect cruise, sometimes weather or technical issues get in the way. Please note that if we have safely completed 60% of your scheduled time before an interruption occurs, the trip will be considered fulfilled.

Operator Cancellations: If a trip is cancelled by LisbonBoat due to safety, weather constraints, or technical force majeure, a full refund of the amount paid or a rescheduled alternative date will be offered. Under Portuguese civil law, cancellations due to unpredictable natural events represent contract resolution without fault, and no further civil compensation is due.

Client Cancellations: Any cancellation or modification requested by the client must be sent in writing to geral@lisbonboat.pt. Refunds and penalties will apply according to the specific cancellation timeline provided during your booking process. Some services have their own unique conditions.

Any approved refunds shall be processed within a maximum period of 14 days following the scheduled event date.

Late Arrivals and “No-Shows”

Private Charters: If a client shows up 45 minutes late, the trip still ends at the scheduled time so it doesn’t disrupt subsequent bookings. No partial refunds or extensions are granted for lost time.

Public Tours: The boat leaves precisely at the scheduled departure time. Passengers who arrive late are treated as “No-Shows” and forfeit 100% of their ticket price.

5.Payment Terms

Booking Deposit: A deposit (the percentage or specific amount depends on the case) of the total event cost is required to secure your reservation.

Final Balance: The remaining amount must be settled at least 7 days prior to the event date, or directly on the day of the event if this was agreed upon in advance.

Payment Fees: Depending on your chosen payment method, additional transaction fees may apply. These fees are the client’s responsibility and remain strictly non-refundable, even in the event of a cancellation.

Invoices: If you require a tax invoice, please provide your company or tax details at the time of payment.

6. On-Board Safety, Rules, and Conduct

Skipper Authority: In strict compliance with Portuguese maritime safety regulations, the Captain/Skipper is in absolute command of the vessel. All passengers must strictly follow crew and skipper instructions and safety briefings at all times.

Behavior and Substance Use: Inappropriate behavior, disrespecting the crew, safety violations, violence, or excessive consumption of alcohol will not be tolerated.

Right to Terminate: LisbonBoat reserves the right to immediately terminate the service without any refund or compensation if any passenger refuses to follow safety guidelines or exhibits behavior that risks their own safety, other passengers, the crew, or the vessel.

Equipment: Operating or tampering with the vessel’s audio, navigation, and control systems is strictly forbidden. The client shall be solely responsible for the cost of repairing any damage caused to the vessel or its equipment.

Smoking Policy: Smoking inside vessel cabins is strictly illegal and prohibited and subject to a €150 fine. Smoking is only permitted in designated open-air deck areas and requires prior approval from the skipper.

Alcohol: For safety and decorum, the crew reserves the right to refuse boarding to any individual displaying signs of visible intoxication. Our priority is maintaining a secure and respectful environment onboard.
It is strictly forbidden for individuals under the age of 18 to consume alcohol onboard. The crew is authorized to request proof of age at any time.

Health & Swimming Limitations: Clients must inform the crew/skipper prior to boarding if they or anyone in their party cannot swim, has mobility restrictions, or suffers from medical conditions affecting their physical safety on a motor or sailing yacht.

  • (Children up to 10 years old must wear a life jacket at all times. Those over 10 who feel they should wear one are encouraged to ask the crew.)

  • Entering the water without prior approval from the crew is strictly forbidden. Passengers must comply with all crew directives. The vessel accepts no liability for swimming activities, which are performed solely at the guest’s own risk.

  • Caution: Exterior decks can be slippery. Please watch your step and follow all crew instructions.

  • If you feel seasick, we have motion sickness tablets available — please do not hesitate to ask the crew.

Vessel Capacity Limits: The maximum passenger capacity of the vessel must be strictly respected. Please note that babies and children of all ages count toward the total passenger headcount.

Prohibited Items & Guidelines

To ensure the safety, cleanliness, and maintenance of the vessel, the following items are restricted onboard:

  • Glassware: Glass cups and glass beer bottles are not allowed (cans only).

  • Staining Beverages: Red wine, red sangria, black vodka, and any dark-colored or dark-based drinks are strictly prohibited. Light-colored/white drinks should be consumed in moderation.

  • Food Restrictions: Any products that leave greasy stains or persistent strong odors are not permitted on board.

  • Sunscreens & Oils: Self-tanning lotions and body oils are prohibited; please bring traditional sunscreen only.

  • Party Decor & Novelties: Hookahs/shisha, confetti, glitter, and sequins are not allowed.

  • Illicit Substances: Narcotic substances of any kind are strictly forbidden.

  • Pets: Animals are not permitted unless requested and expressly approved in advance.

7. Mandatory Insurance and Limitation of Liability

Insurance Coverage: In strict compliance with Portuguese Decree-Law no. 108/2009 and applicable maritime tourism frameworks, Lisbon Boat maintains all mandatory insurance policies in force, specifically:

Civil Liability Insurance (Responsabilidade Civil): Covering damages to third parties and passengers up to the legal minimums.

Personal Accident Insurance (Acidentes Pessoais): Covering medical treatment expenses and legal compensations for passengers in the event of an accident during the activity.

Passenger Liability: Lisbon Boat cannot be held liable for personal injury, illness, or damage resulting from a passenger’s own negligence, inappropriate behavior, or deliberate disregard for the skipper’s instructions.

Personal Belongings: Passengers are solely responsible for their personal effects (phones, cameras, jewelry, etc.). Lisbon Boat is not liable for items lost, dropped overboard, or damaged by seawater.

8. Deep Sea & Big Game Fishing (Specific Clause)

For specialized fishing charters (e.g., Blue Marlin, Tuna, Deep Sea Fishing), seasonality and species availability vary throughout the year.

All necessary maritime fishing licenses and gear guidelines will be communicated prior to departure. Rules regarding catch-and-release, retention quotas, or minimum sizes are strictly dictated by Portuguese and European fishing regulations and enforced by the skipper.

9.JetSki (Specific Clause)

Minimum age to drive jet ski is 16 years.

Only two people are allowed to use the JetSki at a time.

To operate a JetSki in a strictly defined area in the bay of Cascais or Oeiras, a license is not required. Leaving the designated area on a JetSki is prohibited.

For license holders, a JetSki is provided under special conditions.

To reach the defined area where JetSki ride will take place from Marina Cascais, a auxiliary boat (max. 6 pax. allowed) with a crew is provided.

Operators are strictly required to keep the safety lanyard secured to their wrist and attached to the ignition switch during the entire duration of operation while the engine is running.

10. Website Usage & Intellectual Property

All content published on https://lisbonboat.pt—including text, graphics, logos, images, layout, and software—is the intellectual property of Lisbon Boat or its content suppliers and is protected by Portuguese and international copyright laws. Unauthorized reproduction or redistribution is strictly prohibited.

11. Complaints, Disputes, and Jurisdiction

Electronic Complaints Book (Livro de Reclamações Eletrónico): Lisbon Boat provides access to the official digital complaints platform in Portugal. You can access it directly at www.livroreclamacoes.pt.

Alternative Dispute Resolution (RAL): In the event of a consumer dispute that cannot be resolved amicably between the parties, the consumer may turn to an Alternative Dispute Resolution entity. For the Lisbon/Cascais region, the competent body is the Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL) (Website: www.centroarbitragemlisboa.pt).

Governing Law & Competent Courts: These Terms and Conditions are governed by and construed in accordance with Portuguese Law. For any judicial disputes arising directly from these terms or our services, the courts of Lisbon, Portugal, shall have exclusive jurisdiction.
